Estate Planning is the development of a plan for managing your assets and affairs during your lifetime, in case of incapacity, and upon your death. EPS' attorneys will tailor an estate plan to meet your particular needs. This may involve basic estate planning (e.g. - Wills, Trusts, etc.), advanced estate and tax planning (e.g. - Charitable Trusts, etc.), or planning for persons with a disability or special needs (e.g. - Special Needs Trusts).
Elder Law is an area of the law that addresses issues affecting the elderly, including estate planning, retirement benefits, coordination and financing of elder care, governmental benefits (Social Security, Medicaid, etc.), protecting the elderly from abuse, and advocating for the rights of the elderly. EPS' attorneys, staff, and Elder Care Coordinator, assist the elderly and their families every day with these and other issues.
At EPS, one of our primary goals is to assist our clients prepare an estate plan that prevents any unnecessary probate court involvement. However, for those who have not done the planning required to avoid probate or if disputes arise regarding a deceased or incapacitated person's affairs, it may be necessary to initiate a proceeding in the probate court.
